1. GENERAL
Studio Jacobson is a Melbourne-based creative studio founded by Danny and Mary Jacobson, offering original artworks, custom art commissions, and design services. These terms apply to all purchases made through our website or via direct correspondence.
2. ORIGINAL ARTWORK PURCHASES
All original artworks are one-of-a-kind pieces. Once sold, they are no longer available.
Artwork descriptions, dimensions, and photography are provided in good faith and are as accurate as possible. However, colours may vary slightly between screens and in person due to differences in display settings and photographic lighting. This does not constitute a defect.
All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable.
3. CUSTOM COMMISSIONS
Commission requests are subject to availability and acceptance at Studio Jacobson's discretion.
A non-refundable deposit (typically 50% of the agreed price) is required to commence any commissioned work. The remaining balance is due prior to delivery or collection.
Once a commission has commenced, changes to the brief may incur additional costs or delays. Major changes requested after work has begun may be treated as a new commission.
As commissioned works are created specifically for you, they are non-refundable unless they are found to be faulty or significantly different from the agreed brief.
4. SHIPPING
We ship original artworks within Australia. Please contact us at info@studiojacobson.com.au to enquire about international shipping availability and costs.
Shipping costs are calculated at checkout or quoted separately for larger works. All artworks are carefully packaged to minimise the risk of damage in transit.
Estimated delivery timeframes are provided in good faith but are not guaranteed. Studio Jacobson is not liable for delays caused by third-party couriers or circumstances beyond our control.
Risk of loss or damage passes to the buyer upon handover to the courier. We strongly recommend inspecting your artwork upon delivery and noting any damage with the courier at the time of receipt.
5. RETURNS & REFUNDS
We want you to love your artwork. If you have concerns about your purchase, please contact us within 7 days of receiving your order.
Under the Australian Consumer Law (ACL), you are entitled to a refund or replacement if a product is faulty, not as described, or fails to do what it is supposed to do. These statutory rights are not limited by these terms.
Change-of-mind returns are accepted at our discretion. If approved, the artwork must be returned in its original condition and packaging, and the buyer is responsible for return shipping costs. A refund will be issued upon safe receipt of the returned work, minus any original shipping costs.
Custom commissions are non-refundable except where required by the ACL.
6. INTELLECTUAL PROPERTY
Studio Jacobson retains all intellectual property rights to all artworks, images, and content displayed on this website, including the right to reproduce images of sold works for portfolio and promotional purposes.
Purchase of an artwork transfers physical ownership only. It does not transfer copyright or any reproduction rights. Reproduction, copying, or commercial use of any artwork or image from this website without prior written consent is strictly prohibited.
7. PRIVACY
We collect personal information (such as name, address, and email) solely for the purpose of processing orders and communicating with you. We do not sell or share your information with third parties except as required to fulfil your order (e.g., courier services).

8. LIMITATION OF LIABILITY
To the extent permitted by law, Studio Jacobson's liability for any claim arising from a purchase is limited to the purchase price of the relevant artwork or service.
We are not liable for any indirect, incidental, or consequential loss or damage arising from use of this website or purchase of our products.
9. GOVERNING LAW
These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
